The European Commission has designated ChatGPT under the Digital Services Act, and classed it as a search engine rather than a platform. Nvidia will hold the lease on the Texas site where Anthropic is buying 35 billion dollars of compute. Anthropic has paused some of its own risky training runs and disclosed a second model that got loose.
Brussels has pulled a general purpose AI assistant inside the Digital Services Act for the first time, and the route it took is the part worth reading twice. ChatGPT was not designated a very large online platform. It was designated a very large online search engine, on the reasoning that it is a hybrid service that qualifies as a search engine under the Act. The Commission's own register declares it at 159.1 million monthly users in the European Union, against a threshold of 45 million. Reddit and Roblox were designated the same day, as platforms. The legal characterisation will outlast the designation.

The threshold is 45 million monthly users in the Union. The register declares ChatGPT at 159.1 million, Reddit at 57.2 and Roblox at 46.6. All three have four months to comply.

The Wall Street Journal reported on Monday that Anthropic has signed a $35 billion cloud deal with Lambda, and that Nvidia will supply the chips and hold the lease on the Texas site. The builder, Hut 8, described the campus in a filing in July: one gigawatt at Beacon Point in Nueces County, a second lease worth $9.8 billion for 352 megawatts, doubling a tenant's contracted capacity to 704 MW. It named that tenant only as high investment grade. What is new is the name. Nvidia supplies the chips, holds the lease and owns part of Lambda.

Anthropic has paused some of its own risky training environments, and disclosed a second model that got loose on the internet
Anthropic published its response to the evaluation escapes on Monday. It paused external cyber evaluations of pre release models and paused higher risk reinforcement learning environments for several weeks, some of which remain paused. It has deployed a real-time classifier that catches an escape attempt and kills the call before it executes. It also disclosed a second incident: on August 4 the UK AI Security Institute reported that Claude Mythos 5 took a series of unauthorized actions on the live internet. It says the industry should adopt a mechanism for coordinated pacing.

Apple has told a court that a trade secret fed into an AI agent may be uniquely challenging to undo
Apple filed a supplemental brief on Monday in its trade secrets case against a former engineer and OpenAI. The argument is new: when trade secret information is fed into an AI agent or model that "learns" from it, Apple's brief says, that learning may create "irreversible and continually propagating uses of the trade secret," harm that is, "at a minimum, uniquely challenging to undo." Two expert declarations support it, and Apple wants expedited discovery. It says forensic artifacts are at risk of being lost or overwritten, which is not the same as saying anyone has destroyed them.

Nvidia took 3.5 billion dollars of a MediaTek bond that pays no interest, and the money is for MediaTek's parts bill
Nvidia said on Monday that it had invested $3.5 billion in convertible bonds issued by MediaTek. MediaTek's own filing with the Taiwan exchange, five minutes earlier, carries the terms the announcement leaves out. The issue is $3.9 billion, so Nvidia took about ninety percent of it. The coupon is zero. It runs five years and converts at 115 percent of Monday's closing price. The filing also gives the purpose of the proceeds, which is funding foreign currency component purchasing. One chipmaker is lending another the money to pay for parts.

A Chinese lab's first results as a listed company show its interface revenue up 2,735 percent
Z.AI, which was called Knowledge Atlas until July, filed interim results in Hong Kong on Monday. Revenue rose 399.7 percent to 953.9 million yuan, but the mix moved much further. Open platform and interface revenue rose 2,735.7 percent and is now 86.5 percent of the total, while enterprise sales of on premise models fell 54.6 percent. Research spending was 2.13 billion yuan, more than twice revenue, and the reported loss narrowed to 2.07 billion yuan even as the adjusted net loss widened. The filing also claims inference across a cluster of more than 100,000 domestic chips.

The Pentagon put ChatGPT and Grok on one platform, both cleared for controlled unclassified data
The two war.gov releases turn out to be public, both dated Monday. ChatGPT Mil and Starshield AI's Grok for Government landed on GenAI.mil the same afternoon, both accredited for Controlled Unclassified Information at Impact Level 5. ChatGPT Mil is built for the Department's 3 million-plus personnel; GenAI.mil itself has onboarded 1.7 million of them since launching nine months ago.
